These Terms of Service ("Terms") govern your use of the StorScale platform and services operated by StorScale ("we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

StorScale provides market intelligence, competitive rate monitoring, and pricing recommendation tools for self-storage operators ("Services"). Our Services include free audit reports, paid subscription features, and related data analytics.

2. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You must be at least 18 years old to use our Services

3. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Services or related systems
• Scrape, crawl, or use automated means to extract data from the platform beyond normal API usage
• Resell, redistribute, or sublicense access to the Services or data without our written consent
• Interfere with or disrupt the integrity or performance of the Services
• Upload or transmit viruses, malware, or other harmful code

4. Subscriptions and Payment

• Paid plans are billed monthly or annually as selected at the time of purchase
• All fees are in US dollars and are non-refundable except as required by law
• We may change pricing with 30 days' written notice; existing subscriptions remain at their current rate until renewal
• Founding Member rates are locked for the lifetime of the subscription as long as the account remains active and in good standing
• You may cancel your subscription at any time; access continues until the end of the current billing period

5. Free Audit Tool

• The Free Facility Audit provides estimated scores and revenue projections based on publicly available data and our proprietary models
• Results are indicative and should not be relied upon as financial advice
• By submitting an audit request, you consent to us analyzing publicly available information about the facility at the address provided
• We may contact you about your audit results and our Services using the contact details you provide

6. Data and Intellectual Property

Your data: You retain ownership of any data you upload or input into the platform. You grant us a limited license to process this data to provide the Services.

Our data: Market data, analytics, scores, recommendations, and other outputs generated by our platform are our intellectual property. You may use these outputs for your internal business purposes only.

Platform: The StorScale platform, including all code, design, algorithms, and documentation, is our intellectual property protected by copyright and other laws.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Services will be uninterrupted, error-free, or secure
• Market data, scores, or pricing recommendations will be accurate or complete
• Revenue projections or estimates will reflect actual results

StorScale is a market intelligence tool, not a financial advisor. All pricing decisions remain your responsibility.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORSCALE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICES.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless StorScale and its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Services or violation of these Terms.

10. Termination

• You may terminate your account at any time by contacting us
• We may suspend or terminate your access if you violate these Terms or engage in conduct that may harm the platform or other users
• Upon termination, your right to use the Services ceases immediately; we will delete your data within 30 days unless retention is required by law

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use after changes constitutes acceptance.
